2. Acceptance of Terms
By accessing our website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or purchase our products. We recommend you print or save a copy of these terms for your records.
3. Australian Consumer Law
Important: Your Consumer Guarantee Rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Under the Australian Consumer Law (ACL), our products come with automatic consumer guarantees including that goods will:
- Be of acceptable quality (safe, durable, free from defects, acceptable in appearance)
- Be fit for any purpose you made known to us before purchase
- Match the description provided on our website and any samples shown
- Comply with any express warranty we provide
Nothing in these terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law. If there is any conflict between these terms and the ACL, the ACL prevails.
4. Products and Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include GST. Where stated, prices include delivery to Australian addresses. We reserve the right to change prices at any time without notice. The price at the time of order confirmation is the final price for that order.
We make every effort to ensure product descriptions, specifications, and images are accurate. However, product images are for illustrative purposes and actual products may vary slightly in appearance. Technical specifications are subject to change by manufacturers without notice.
5. Orders and Payment
Placing Orders
When you place an order through our website, you are making an offer to purchase. Your order is subject to acceptance by us. We will confirm acceptance by sending an order confirmation email. Until we send this confirmation, no contract exists between us.
We reserve the right to refuse or cancel any order for reasons including:
- Product unavailability or stock shortages
- Errors in product information or pricing on our website
- Suspected fraudulent transactions
- Inability to verify payment or delivery information
If we cancel your order after payment has been taken, we will refund the full amount within 5 business days.
Payment Methods
We accept payment via:
- Credit and debit cards (Visa, Mastercard, American Express) processed securely through Stripe
- Bank transfer (for bulk orders by arrangement)
All card payments are processed by Stripe Payments Australia Pty Ltd (AFSL 500105) using secure, PCI-DSS compliant systems. Payment must be received in full before goods are dispatched.
6. Shipping and Delivery
Delivery Area
We deliver to all Australian states and territories. We do not currently ship internationally.
Delivery Timeframes
Estimated delivery times are:
- Metro areas (Sydney, Melbourne, Brisbane, Perth, Adelaide): 3-7 business days
- Regional areas: 5-10 business days
- Remote areas: 7-14 business days
These are estimates only. Actual delivery times may vary due to carrier schedules, weather events, public holidays, or other circumstances beyond our control. If your order is significantly delayed (more than 14 days beyond the estimated delivery date), please contact us and you may request a refund if goods have not been dispatched.
Shipping Costs
Most products on our website include shipping in the displayed price. Where shipping is charged separately, the cost will be clearly displayed before you complete your order.
Risk and Title
Risk of loss or damage to products passes to you when the products are delivered to the address you specified. Title (ownership) of the products passes to you upon delivery.
If products are damaged in transit, please contact us within 48 hours of delivery with photographs of the damage. We will arrange a replacement or refund.
7. Returns and Refunds
Consumer Guarantee Rights
If a product fails to meet a consumer guarantee under the Australian Consumer Law, you are entitled to a remedy. The type of remedy depends on whether the failure is major or minor:
Major Failure: You can choose a refund, replacement, or compensation for any drop in value. A major failure includes where:
- The product would not have been purchased if the failure was known
- The product is significantly different from the description or sample
- The product is substantially unfit for its normal purpose and cannot easily be fixed
- The product is unsafe
Minor Failure: We can choose to provide a repair, replacement, or refund. We will do so within a reasonable time.
8. Warranty
Manufacturer Warranty (Express Warranty)
In addition to your consumer guarantee rights, Tarsior products come with the following manufacturer warranties against defects in materials and workmanship:
- SO-LUNA Series (Wall, Post, Bollard): 2 years
- SO-AREA (20W Area Light): 2 years
- SO-DOME (15W Garden Light): 2 years
- SO-FLAME (Flame Lights): 2 years
- SO-LAWN (Lawn Light): 2 years
- SO-MARKER (Path Markers): 2 years
- Accessories (Post Kit etc.): 1 year
What Is Covered
The warranty covers manufacturing defects that cause the product to fail under normal use conditions. If a product is found to be defective within the warranty period, we will, at our option, repair or replace the product at no cost to you.
What Is Not Covered
The warranty does not cover:
- Damage caused by misuse, abuse, or accidents
- Improper installation not following provided instructions
- Normal wear and tear (e.g., gradual battery degradation)
- Damage from extreme weather events beyond product ratings
- Modifications or repairs by unauthorised persons
- Cosmetic damage that does not affect functionality
Making a Warranty Claim
To make a warranty claim, contact us at sales@tarsior.com with:
- Your order number or proof of purchase
- Description of the defect or issue
- Photographs showing the problem (if applicable)
We will assess your claim and respond within 5 business days. You may need to return the product at our expense for inspection.
Warranty vs Consumer Guarantees
This warranty is provided in addition to (not instead of) your rights under the Australian Consumer Law. Consumer guarantees may provide broader protection and can apply beyond the warranty period if a product does not last a reasonable time given its price and quality.

9. Limitation of Liability
Subject to your consumer guarantee rights under the Australian Consumer Law (which cannot be excluded), our liability to you is limited to:
- Replacement of the goods or supply of equivalent goods
- Repair of the goods
- Refund of the purchase price
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages including loss of profits, business interruption, or lost data.
Our products are designed for outdoor lighting purposes. We are not liable for any loss or damage arising from use of products for purposes other than those for which they are designed.
10. Product Installation and Safety
Our solar lighting products are designed for self-installation and do not require an electrician. However:
- Follow all installation instructions provided with the product
- Install products in appropriate locations as described in product specifications
- Do not modify or disassemble products (this voids the warranty)
- Ensure products are installed securely to prevent injury or damage
For commercial installations, we recommend engaging a qualified installer. We can provide advice on installation requirements upon request.
